Buc-ee’s Using the Law to Keep Rival Out

Buc-ee’s, the roadside convenience store chain that boasts clean restrooms, cheap gasoline and a mind-boggling “wall of candy” is turning to the courts to stop a Nebraska company from coming into the Texas market. It isn’t the competition that bothers Buc-ee’s, but rather, the fact that the company, based in Omaha, is branding the stores “Bucky’s.”

According to a federal suit Buc-ee’s filed in Houston, Bucky’s parent company Buck’s plans to build at least six convenience stores within the next year in Houston and Nassau Bay. The suit alleges that Buck’s, which operates in other states under the brand name “Bucky’s,” is trying to confuse potential customers by using a similar-sounding name. Buc-ee’s wants an injunction to stop the competitor from moving ahead with its plans, and is accusing Bucky’s of trademark infringement and unfair competition.
