Renting and leasing properties through short-term rental (STR) services such as HomeAway and Airbnb is illegal in San Marcos, which is about 20 miles south of Austin. The city wants to ensure enough housing stock is available for families and others requiring traditional residences.
However, the San Marcos Planning and Zoning Commission has issued recommendations to legalize STR services. The city council needs to approve the recommendations, which include restricting STR ownership to one property. The city would also grant permits on a case-by-case basis for short-term rental properties in which a property owner doesn’t reside on the premises.
San Marcos wants to avoid what happened in Austin. There, the city had lax limitations on the STR market. By the time the Austin City Council wanted to place limits on how many properties could be used as STRs, it was difficult to enforce the limits.
